Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VantagePoint pickleball league management platform at www.vantagepointpickleball.com (the "Service"), operated by VantagePoint ("we," "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 13 years old to use the Service, and old enough to form a binding contract in your jurisdiction. You are responsible for the accuracy of your account information and for all activity under your account. Keep your credentials confidential and notify us of any unauthorized use.

2. Acceptable Use

You agree not to:

• Use the Service to send unsolicited messages, spam, or messages to people who have not consented.
• Upload or enter phone numbers or email addresses you do not have permission to use.
• Impersonate another person, or misrepresent your affiliation with anyone.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service.
• Use the Service for any unlawful purpose or in violation of applicable messaging laws.
• Scrape, resell, or misuse league or player data obtained through the Service.

3. SMS Text Messaging Terms

By providing your mobile phone number and consenting to receive text messages, or by entering a phone number for another person with their permission, you agree to these SMS terms.

• Program description — VantagePoint sends transactional text messages related to pickleball league participation: league invites, RSVP requests, and schedule updates. These are not marketing messages.
• Message frequency — varies by activity; typically 1–3 messages per event.
• Cost — message and data rates may apply from your carrier.
• Opt out — reply STOP to any message to cancel. You will receive one confirmation message and then no further texts.
• Help — reply HELP for assistance, or contact us below.
• Carrier disclaimer — carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network and filtering.
• Privacy — we do not share mobile information with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Consent to receive text messages is not a condition of purchase or of using the Service.

4. League Organizer Responsibilities

If you organize a league, you are responsible for the contact information you enter. You represent and warrant that you have each recipient's permission to provide their phone number or email address and to send them messages through the Service. You must honor opt-out requests from your players, and you may not use the Service to send marketing or promotional messages to people who have not separately consented to receive them.

5. Payments and Billing

Certain features are paid. Payment terms and pricing are presented at the time of purchase. Payments are processed by our third-party payment processor, and by purchasing you agree to their terms. All fees are non-refundable except where required by law or expressly stated otherwise.

6. Your Content

You retain ownership of the content you submit (such as player information, league details, and images). You grant us a limited license to store, process, and display that content solely to operate the Service. You are responsible for ensuring you have the right to submit it.

7. Our Intellectual Property

The Service, including its software, design, and trademarks, is owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you any right to use our branding without permission.

8. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee uninterrupted or error-free operation.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that ratings, statistics, or calculations are accurate or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, including sending messages without consent. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept the revised Terms.
